Will of Jane Elizabeth Davies, Penpompren, 1896

Transcript

This is the last will of me Jane Elizabeth Davies, of Penpompren near Talybont in the County of Cardiganshire, the wife of John Maurice Davies Esq. I hereby revoke all former wills and testamentary dispositions made by me and hereby appoint my two sons Lewis Maurice Davies, and Henry Seymour Davies (Hereafter called my Trustees) to be the executors and trustees of this my will, I hereby [?] exercise of the powers of appointment conferred upon me by my marriage settlement, or by any other document, and of all other powers and by virtue of all estates and interest me here unto enabling give devise and bequeath all property whatsoever and wheresoever, belonging to me, or over which I have any power of appointment or other power of disposition whatsoever and also direct and appoint that all such property shall go in the manner following (that is to say) To my daughter Jane Mary Anne Wasey the sum of five hundred pounds, to my daughter Eleanor Hope Sydney Anwyl the sum of five hundred pounds, to my daughter Harriet Josephine Davies the sum of one thousand pounds, and all my wearing apparel jewellery and personal ornaments. To my trustees the sum of five hundred pounds and all the property estates and interests of every kind and nature to which I am or may become entitled under will of my late cousin Josephine Cobb Gilbertson upon trust to invest the same, and to apply the income and profits thereof towards the food clothing and maintenance of my son William Edward Davies during his life and after his death upon trust to divide the sum between [?] my trustees in equal shares for their own absolute use and benefit. To my son Charles Francis David Davies the sum of one thousand pounds. To my trustees all my plate and silver in equal shares for their own use and benefit. To the Reverend J.M. Griffiths Vicar of Henfynya [?] the sum of ten pounds. To the Reverend William Morgan Curate of St. Marys Church Aberystwith the sum of ten pounds to Miss Marie Sedgwick of Queens Road Tunbridge Wells the sum of one hundred pounds. To my trustees the sum of fifty pounds upon trust to purchase therewith a complete set of Holy Communion Services with a suitable inscription thereon for the Chapel of Ease belonging to the Established Church of England at Talybont aforsaid. To my said son Lewis Maurice Davies for his own use and benefit absolutely my two freehold farms and lands called respectively Blaenant and Nantynod Estate near Talybont aforesaid, or the money secured thereon or whatover other estate or interest of [?] in the said farms and lands I am competent to dispose of – to my said son Henry Seymour Davies for his own use and benefit absolutely my two dwelling houses and premises situated in Portland Street Aberystwith , all the money secured thereon or whatsoever other estate or interest of and in the said dwelling houses and premises I am competent to dispose of. To my trustees for their own absolute use and benefit in equal shares as tenants in common all the rest residue and remainder of all the real and personal property whatsoever and wheresoever belonging to me, or over which I have any power of appointment or other power of disposition whatsoever, provided always that if my son Charles Francis David Davies, shall fail to claim the said sum, one thousand pounds so bequeathed to him as aforesaid within five years, from the date of my death, I hereby direct that the same shall form part of the residuary estate. In witness there of I have set my hand to this my will, this twenty second day of October one thousand eight hundred and ninety six

Signed by the said Jane Elizabeth Davies as her last will in the presence of us both being present at the same time who in her presence and in the presence of each other have her unto subscribed our names as witnesses

By his will John Maurice Davies of Penpompren, in the County of Cardigan Esquire in confirmation of the Settlement executed on his marriage inter alia devised to his dear wife Jane Elizabeth Davies his Mansion House and farm called Penpompren then in his occupation together with the farm called Tanyrallt and the cottage thereon being part of Penpompren Farm also all that water corn grist mill called Penpompren Mill in the occupation of Elizabeth Morgan and her son John Morgan also all that messuage farm and lands called Tanygraig recently purchased by him all which sd premises were situate in the parish of Llanfihangel Geneu’r Glyn in the County of Cardigan to hold the sd premises unto his sd wife and her assigns for and during the term of her natural life without impeachment of waste and after the death of his sd wife he devised the same with their appurtenances to the intent that his son William Edward Davies might receive therefrom an annuity of 50 pounds during his life payable and with the powers of enforcement as therein mentioned and subject to and charged with a legacy of 1000 pounds to his daughter Eleanor Hope Sydney Anwyl on the death of his said wife he devised the sd heredits and premises to his daughter Jane Marianne Wasey during her life and after her death to his sd daughter E H S Anwyl in fee simple and appointed his wife Jane Elizabeth Davies and his daughther the sd EHS Anwyl executrixes of his will
